A. General Terms and Conditions
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts for the delivery of goods concluded between Sportalm GmbH (hereinafter referred to as "Seller") and consumers as well as entrepreneurs (hereinafter referred to as "Customer") via the online shop.
The Customer's conflicting or differing terms and conditions will not be recognized unless the Seller expressly agrees to their validity in writing.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
An entrepreneur is any natural or legal person or partnership with legal capacity who acts in the exercise of their commercial or independent professional activity.
2. Conclusion of Contract
The products displayed in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to order.
By clicking the "Buy now" or "Submit binding order" button, the Customer submits a binding offer.
The Seller will confirm receipt of the order immediately by email (order confirmation). This does not yet constitute acceptance.
The contract is only concluded by express order confirmation or by dispatch of the goods.
The Seller reserves the right to refuse orders without stating reasons.
3. Right of Withdrawal and Return Shipping Costs
Consumers have a statutory right of withdrawal.
The withdrawal period is 14 days from receipt of the goods.
The Seller bears the costs of return shipping.
The goods must be returned unworn, undamaged and, if possible, in their original packaging.
4. Prices and Payment Terms
All prices are final prices and include the statutory value-added tax.
Additional shipping costs will be shown separately.
The following payment methods are available:
- Credit card (Visa, Mastercard)
- PayPal
- Klarna Invoice (for consumers only, payment term 30 days)
- AmazonPay
When using external payment service providers, their terms and conditions also apply.
Refunds are made via the payment method used.
5. Delivery and Shipping Conditions
Delivery will be made to the delivery address specified by the Customer.
Delivery times (non-binding guidelines):
- Austria: 1–2 working days
- Germany: 2–3 working days
- Netherlands: 3–5 working days
- Rest of world: 3–5 working days
If an item is not available, the customer will be informed immediately.
For consumers, the risk of loss or damage to the goods only passes upon handover to the customer.
If delivery fails due to reasons attributable to the customer, the customer shall bear the costs of a new delivery.
6. Warranty and Guarantee
The statutory warranty rights apply.
The warranty period is two years from delivery of the goods.
For consumers, the burden of proof is reversed for one year.
Guarantees only exist if they are expressly stated.
7. Liability
The Seller is liable without limitation for damages resulting from injury to life, body or health, as well as for intent and gross negligence.
In cases of slight negligence, the Seller is only liable for the breach of essential contractual obligations and limited to the foreseeable, typical contractual damage.
8. Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, mandatory consumer protection provisions of the state of their habitual residence remain unaffected.

3. Information on the Essential Characteristics of the Goods
The essential characteristics of the goods result from the respective product description.
Color deviations may occur due to technical characteristics of the display.
4. Information on the Conclusion of the Contract
The contract is concluded in accordance with Section 2 of these GTC.
5. Information on Payment and Delivery
Payment and delivery are made in accordance with Sections 4 and 5 of these GTC.
6. Technical Steps for Concluding the Contract
The customer goes through the following steps:
- Selection of goods
- Adding to shopping cart
- Entering customer data
- Selection of shipping and payment method
- Review of the order
- Binding submission of the order
7. Storage of the Contract Text
The contract text is stored and sent to the customer by email.
8. Correction of Input Errors
Input errors can be corrected at any time before submitting the order.
9. Contract Language
The contract language is German.
10. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

The Seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
